El artículo aborda la responsabilidad médica penal por omisión en situaciones de emergencia de salud, debido a las dudas que aún existen sobre el accionar médico en estas circunstancias y las posibles consecuencias jurídicas por negligencia, impericia e imprudencia. La responsabilidad médica incluye la obligación moral de responder de los propios actos y reparar o indemnizar las consecuencias perjudiciales para terceros. Se identifican las falencias en las normativas ecuatorianas con relación al actuar médico en situaciones de emergencia de salud y (...) se busca aportar a la academia con publicaciones de conocimiento. Se analizan los elementos normativos y fácticos de la responsabilidad médica penal por omisión en situaciones de emergencia de salud en la República de Ecuador, y se busca identificar el marco normativo en la legislación ecuatoriana para superar la inadecuada actuación médica en estas situaciones. El conocimiento de la normativa legal contribuye a superar la responsabilidad médica penal por omisión en situaciones de emergencia en el Ecuador y se menciona y se analiza el art.146 del COIP que es la normativa vigente. El artículo concluye que el objetivo no es criminalizar la práctica médica, ya que no toda muerte es homicidio y no todo proceso judicial implica el encarcelamiento de los involucrados. (shrink)

La confianza en el libre mercado ha producido la mayor concentración de empresas mediáticas. El "cuarto poder" no contribuye a la limitación del poder del Estado. Se estudian los conceptos claves de fortuna, virtù y gloria, con elobjeto de buscar algunas aclaraciones sobre el problema de larelación entre moral y política en Maquiavelo. La virtù maquiavelianaincluye, sin duda, múltiples componentes de energía, talento,pero no está completamente exenta de elementos morales. Delconcepto de fortuna podemos extraer una serie de criterios parala acción política que forman parte de la virtù maquiaveliana, lacual, si bien se aleja de la moral cristiana vigente en su tiempo, lesitúa dentro de una moral (...) republicana. Del examen del conceptode gloria descubrimos cómo la gloria es recompensa de la virtù,pero no se reconoce a cualquier político que tiene éxito en susempresas, sino solo a quien salva a la patria y lo hace con mediosbenignos. The creation of a citizen militia is a characteristic pretension of the Renaissance republicanism. The republic cannot lack defense nor defend themselves with mercenary armies. For Machiavelli, Guicciardini or Giannotti the citizen has a set of virtues, like austerity, discipline, patriotism or bravery, that make him the best soldier. Therefore, the Republican regime needs the citizens to be soldiers, because the military discipline itself is a means necessary to forge such civic virtues without which no republic can survive.

La lectura de los clásicos, el estudio de la historia y la atenta observación de la práctica política de su tiempo le llevarán a Maquiavelo a romper con la tradición humanista sobre la propiedad y a defender la necesidad de limitaciones sobre la misma. Su concepción republicana sobre la propiedad se concentra en el lema de que la ciudad sea rica y los ciudadanos pobres. Esto supone una política de moderación que excluye por igual la concepción oligárquica de quienes confunden (...) la riqueza de la ciudad con la de sus gobernantes; así como el igualitarismo radical de los que niegan con su exclusivismo la existencia de los dos humores que debidamente coordinados hacen que una república, con un gobierno mixto, sea segura, estable y rica. Since the 1980s, there has been a significant increase in the number of studies concerning Andalusian rural settlements linked to irrigated agriculture, both related to large suburban green belts and to small hydraulic systems. In the vast areas where water is scarce, the settlement apparently would have been concentrated in cities and fortified towns, leaving without population most of the dry lands between them. However, thanks to the intensive survey of one of these regions, La Mancha’s Southeastern area, we are (...) recording a dense rural settlement corresponding to a pattern unknown until now. It consists basically of small villages in plain, devoid of community defense elements, which must have been inhabited by humble peasants, judging by the modesty of the architecture and domestic goods. Surely they make use of the scanty natural resources, which have traditionally oriented the economy of the region towards livestock and rainfed agriculture. In particular, the studied settlement would be related to the demand of wool for the export oriented textile production of the region, within the framework of the commercial expansion of that period. Apparently, most of those villages could have appeared in the eleventh century, disappearing in the middle of the thirteenth century because of the Christian conquest. Their existence would be associated with a general context of population growth that pushed the competition between urban elites and peasants pursuing the privileged agricultural areas, as well as the colonization of less favorable production areas. Surgical patient safety remains a concern worldwide as, despite World Health Organization recommendations and implementation of its Surgical Safety Checklist, adverse events continue to occur. The aim of this qualitative study was to explore the views and experiences of perioperative nurses regarding the factors that impact surgical patient safety. Data were collected through five focus groups involving a total of 50 perioperative nurses recruited from four public hospitals in Spain. Content analysis of the focus groups yielded four main themes: personal (...) qualities of the perioperative nurse, the surgical environment, safety culture, and perioperative nursing care plans. One of the main findings concerned barriers to the exercise of leadership by nurses, especially regarding completion of the Surgical Safety Checklist. Some of the key factors that impacted the ability of perioperative nurses to fulfil their duties and ensure patient safety were the stress associated with working in the operating room, time pressures, and ineffective communication in the multidisciplinary team. Targeting these aspects through training initiatives could contribute to the professional development of perioperative nurses and reduce the incidence of adverse events by enhancing the surgical safety culture. Background:The acquisition of experience is a major concern for nurses in intensive care units. Although the emotional component of the clinical practice of these nurses has been widely studied, greater examination is required to determine how this component influences their learning and practical experience.Objective:To discover the relationships between emotion, memory and learning and the impacts on nursing clinical practice.Research design:This is a qualitative phenomenological study. The data were collected from open, in-depth interviews. A total of 22 intensive care unit nurses (...) participated in this research between January 2012 and December 2014.Ethical considerations:The School of Nursing Ethics Committee approved the study, which complied with ethical principles and required informed consent.Findings:We found a clear relationship between emotion, memory and the acquisition of experience. This relationship grouped three dimensions: (1) satisfaction, to relieve the patient’s pain or discomfort, give confidence and a sense of security to the patient, enable the presence of family members into the intensive care unit and provide family members with a realistic view of the patient’s situation; (2) error experience, which nurses feel when a patient dies, when they fail to accompany a patient in his or her decision to abandon the struggle to live or when they fail to lend support to the patient’s family; and (3) the feel bad–feel good paradox, which occurs when a mistake in the patient’s care or handling of his or her family is repaired.Conclusion:Emotion is a capacity that impacts on nurses’ experience and influences improvements in clinical practice. Recalling stories of satisfaction helps to reinforce good practice, while recalling stories of errors helps to identify difficulties in the profession and recognise new forms of action. The articulation of emotional competencies may support the development of nursing ethics in the intensive care unit to protect and defend their patients and improve their relationships with families in order to maximise the potential for patient care. Automatic control of physiological variables is one of the most active areas in biomedical engineering. This paper is centered in the prediction of the analgesic variables evolution in patients undergoing surgery. The proposal is based on the use of hybrid intelligent modelling methods. The study considers the Analgesia Nociception Index to assess the pain in the patient and remifentanil as intravenous analgesic. The model proposed is able to make a one-step-ahead prediction of the remifentanil dose corresponding to the current state (...) of the patient. The input information is the previous remifentanil dose, the ANI variable and the electromyogram signal. Modelling techniques used are Artificial Neural Networks and Support Vector machines for Regression combined with clustering methods. Both training and validation were done with a real dataset from different patients. Results obtained show the potential of this methodology to calculate the drug dose corresponding to a given analgesic state of the patient. (shrink)

Present research proposes the application of unsupervised and supervised machine-learning techniques to characterize Android malware families. More precisely, a novel unsupervised neural-projection method for dimensionality-reduction, namely, Beta Hebbian Learning, is applied to visually analyze such malware. Additionally, well-known supervised Decision Trees are also applied for the first time in order to improve characterization of such families and compare the original features that are identified as the most important ones. The proposed techniques are validated when facing real-life Android malware data by (...) means of the well-known and publicly available Malgenome dataset. Obtained results support the proposed approach, confirming the validity of BHL and DTs to gain deep knowledge on Android malware. (shrink)

There are numerous studies that, from different perspectives, have dealt with the debate held in the Spanish Empire during the 16th century on the slavery of the American Indians, starring –among others– by Francisco de Vitoria and his disciples from the School of Salamanca, and also –outside the academic sphere– by Fray Bartolomé de las Casas and Juan Ginés de Sepúlveda. The purpose of this work is to study whether this debate made its mark in Spanish society. For this, it (...) is analyzed three theatrical pieces from the Golden Age signed by playwrights of the stature of Tirso de Molina, Lope de Vega and Pedro Calderón de Barca, who –given their enormous popularity– had the capacity to reach the wide audience that congregated in the corrals of comedies. Were these three writers influenced by the controversy over the Indians carried out, among other authors, by Vitoria, Las Casas and Sepúlveda? Did they fully grasp in their works the subtle debate that Vitoria, Las Casas and Sepúlveda maintained when they interpreted Aristotelian arguments on slavery and the consequences that derived from them in terms of the possibility of enslaving or not the Indians? El éxodo de más de 5,6 millones de venezolanos representa un fenómeno migratorio con múltiples facetas, cada una merecedora de atento análisis y profundización. Ante la dimensión del movimiento de millones de seres humanos, se corre el riesgo de subestimar tragedias que ocurren dentro del drama migratorio. Una de ellas, es el exilio de científicos y académicos. Bajo esta perspectiva, la investigación tiene como objetivo general mostrar la banalización frente al riesgo de pérdida de talento y avance científico de países (...) en vías de desarrollo. Tomamos como objeto de estudio el caso de la Diáspora Científica Venezolana. Se abordan de forma multidisciplinar tres ejes temáticos: 1) Causas y consecuencias de la Ciencia en Riesgo, 2) Instrumentalización de la Ciencia en Riesgo y 3) Efectividad de programas dirigidos a científicos en riesgo. El primer eje temático, está fundamentado en analizar las causas y consecuencias de la Diáspora científica venezolana, centrándonos en los estudios realizados, desde el ámbito sociológico, de Iván de la Vega, Francisco Kerdel-Vegas y Tomás Páez. El segundo eje establece, desde el marco filosófico habermasiano-marcusiano, la conveniente preservación del statu quo de la Ciencia en riesgo, a través de instrumentalización y unidimensionalidad del quehacer científico en países en vías de desarrollo por parte de programas internacionales financiados por organismos privados y gubernamentales. El tercer y último enfoque tiene como punto de partida la situación actual de la diáspora científica y la exposición de soluciones eficaces que rompan la inercia presente, enmarcando las ideas dentro de la actual crisis de la posmodernidad. Este trabajo examina cómo, para ocupar la tribuna vacante del filósofo-orador José Ortega y Gasset, el exiliado Eduardo Nicol elaboró el emergente problema contemporáneo de la relación entre retórica y filosofía. Esta cuestión atañe tanto al qué como al para qué de la filosofía. ¿Hay un “grado cero” retórico en el pensamiento? Y si existe, ¿es el grado óptimo, considerando la meta humana de la filosofía? Nicol respondió ambas preguntas avanzando sobre la semiótica fenomenológica de Husserl, para establecer en (...) la comunicación humana la constitución simultánea de expresión, significación y objetividad; y renunciando a la brillantez ensayística de Ortega como paradigma de influencia cultural de la filosofía. Pero, en el primer camino, no extrajo todas las consecuencias de su expresionismo; en el segundo, hubo de admitir una norma retórica algo diferente del grado cero, ya que la humanidad estaba en peligro. El caso de Nicol, en diálogo con todas las corrientes de la filosofía contemporánea, reafirma el lugar central que en ellas viene ocupando la semiótica. (shrink)

Just Ecological Integrity presents a collection of revised and expanded essays originating from the international conference "Connecting Environmental Ethics, Ecological Integrity, and Health in the New Millennium" held in San Jose, Costa Rica in June 2000. It is a cooperative venture of the Global Ecological Integrity Project and the Earth Charter Initiative.

A large part of technological advances, especially in the field of industry, have been focused on the optimization of productive processes. However, the detection of anomalies has turned out to be a great challenge in fields like industry, medicine or stock markets. The present work addresses anomaly detection on a control level plant. We propose the application of different intelligent techniques, which allow to obtain one-class classifiers using real data taken from the correct plant operation. ven a cursory look at the extensive literature on mindreading in nonhuman animals reveals considerable variation both in what mindreading abilities are taken to be, and in what is taken as evidence for them. Claims that seem to contradict each other are often not inconsistent with each other when examined more closely. And sometimes theorists who seem to be on the same side are actually talking at cross-purposes. The first aim of this paper is to tackle some important framework questions (...) about how exactly the mindreading hypothesis is to be stated. It emerges in sections 1 and 2 that there are three importantly different versions of the mindreading hypothesis that need to be distinguished. The first (which I call minimal mindreading) occurs when a creature’s behavior covaries with the psychological states of other participants in social exchanges. The presence of minimal mindreading is not in itself evidence for the presence of what I term substantive mindreading. Substantive mindreading involves attributions of mental states. There are different levels of substantive mindreading, varying according to the category of mental state attributions that they involve. Section 2 explores different types of substantive mindreading, according to the extent to which they involve explicitly representing the agent’s backgtround psychological profile. This gives us a principled way of distinguishing propositional attitude mindreading from perceptual mindreading. -/- It is clear that much of the reasoning behind attributions of mindreading abilities to nonlinguistic creatures is analogical in nature. We see in section 3 that much of the discussion in this area proceeds on the basis of a double analogy between animal cognition and human cognition. Researchers assume both that animals solve many problems of social coordination that are analogous to problem solved by humans and that since humans solve those problems using mindreading strategies, so too do non-human animals. How we apply the second analogy, of course, depends upon our interpretation of the particular mindreading strategies that humans employ – in particular, it depends upon the centrality of propositional attitude psychology (or folk psychology) in human social understanding and social coordination. There are good reasons for thinking that the role of propositional attitude psychology in human social life is very much over-stated. This has repercussions for how we think about substantive mindreading in nonhuman animals. It very much weakens the analogical case for identifying propositional attitude mindreading in nonlinguistic creatures. -/- Suspicion of claims of propositional attitude mindreading in non-human animals turns out to be well-founded. In section 4 I present a revised version of an argument I have given elsewhere (Bermúdez 2003) to show that the most sophisticated form of substantive mindreading (the type of mindreading that exploits the concepts of propositional attitude psychology) is only available to language-using creatures. O presente artigo tem como objetivo abordar a governamentalidade proposta por Michel Foucault como ferramenta de análise a ser utilizada em investigações no campo da educação. Considerando sua tradição arqueogenealógica, ao romper com perspectiva de um continuum historiográfico em favor de uma descontinuidade histórica, trata-se de uma mirada sobre os acontecimentos para além da tradicional narrativa encadeada dos fatos, convertendo-se em uma analítica das condições de possibilidade para a emergência de outras formas de se pensar e agir sobre a história. Em assim sendo, a governamentalidade nos permite examinar, no interior de organizações discursivas, novas formas de racionalidade política e suas respectivas tecnologias para o governamento a partir dos modos de produção de saber em sua articulação com as relações de poder que, em um sentido prático, atuam sobre processos de subjetivação. _Art and Morality_ is a collection of groundbreaking new papers on the theme of aesthetics and ethics, and the link between the two subjects. A group of distinguished contributors tackle the important questions that arise when one thinks about the moral dimensions of art and the aesthetic dimension of moral life. The volume is a significant contribution to philosophical literature, opening up unexplored questions and shedding new light on more traditional debates in aesthetics. The socialism that spread globally after the Russian Revolution of 1917 emerged as a radical political avant-garde in Latin America. In Peru's case, this strain of the avant-garde was not only a literary and artistic movement but also a set of cultural and political practices, the goal of which was the articulation of socialist dreamworlds for a modern nation. In the 1920s, these dreamworlds consisted of alternative utopian narratives to capitalism that envisioned the indio as the modern subject who would (...) reconfigure ideas of community in the country. This article analyzes the utopian narratives of José Carlos Mariátegui, Víctor Raúl Haya de la Torre, and Luis E. Valcárcel, who initially shared many ideals but ultimately took different paths. This study identifies which utopian narrative finally prevailed and their legacy as a blueprint for future ways of thinking about social justice and community in Peru. (shrink)

Elite athletes are characterized by their high level of performance in sport. Since the very beginnings of sport, it has been understood that physical and physiological abilities influence the performance of athletes. Advances in scientific knowledge, especially sport psychology and neuroscience, seem to confirm this intuition and consequently it is possible to characterize elite athletes as having an extraordinary combination of physical and mental abilities. Techniques and substances that contribute to enhancing physical characteristics of athletes have also been well known (...) for ages. But it is now possible to make use of other techniques and substances that not only enhance physical abilities but also cognitive capabilities, which seem to require greater consideration given their direct impact on the athlete’s brain. In this article, we examine two such techniques, cognitive enhancers and transcranial stimulators, and highlight the potential advantages and drawbacks that applying each one may have on sport. Given the relative novelty of these enhancement techniques and substances and the absence of conclusive evidence regarding their short- and long-term effects, we deem that their use ought to be strictly governed by cautionary principles. But due to that same lack of evidence, we believe that the possibility of examining the feasibility of applying these techniques to sport should not be denied. (shrink)

Consider any subvariety of BL-algebras generated by a single BL-chain which is the ordinal sum of the standard MV-algebra on [0, 1] and a basic hoop H. We present a geometrical characterization of elements in the finitely generated free algebra of each of these subvarieties. In this characterization there is a clear insight of the role of the regular and dense elements of the generating chain. As an application, we analyze maximal and prime filters in the free algebra.

Julián Marías es uno de los pensadores humanistas más completos del siglo XX y uno de los intelectuales más grandes de la España contemporánea.
